Terms and Conditions of the GREEN GURU Rewards Program

The GREEN GURU Rewards Program has been created by the company BIOLOGIKO XORIO A.E. (hereinafter referred to as “BIOLOGIKO XORIO”), based in Athens, Attica, at 128 Alexandras Avenue, Postal Code 11471, with Tax Identification Number VAT No. 800847213 and General Commercial Registry Number 142864601000, tel.: +30 2114002101. It is aimed at adult customers of BIOLOGIKO XORIO stores and of www.biologikoxorio.gr and concerns the logging and analysis of the purchases they make as members of the Program.

The purpose of the GREEN GURU Rewards Program is, on the one hand, to reward customers who choose the Company’s stores and e-shop for their purchases and to provide them with priority information about its products and services and, on the other hand, to log, analyze and study purchasing behavior (product categories selected, visit frequency, type of products chosen by customers, response to general and specialized offers, etc.), in order to improve the management of its customer base and the provision of products and services that best suit said customer base.

1. ISSUANCE OF ELECTRONIC MEMBERSHIP CARD — USE OF THE CARD

• Anyone who is 18 years of age or older is eligible to register for the Program.
• By accepting these Program Terms and Conditions, the member consents to receiving informational and/or promotional messages from BIOLOGIKO XORIO.
• Upon registration in the Program, an electronic membership card is automatically issued.
• The electronic card is strictly personal. The transfer, in any manner whatsoever, of the card and of the points earned to any person is prohibited.
• The electronic card, which is accompanied by the declaration of the holder’s personal details, may be obtained at BIOLOGIKO XORIO physical stores, at www.biologikoxorio.gr and through the BIOLOGIKO XORIO APP.
• The member is entitled to use the card for purchases across all BIOLOGIKO XORIO sales channels and always in accordance with these Terms and Conditions, which may be amended by BIOLOGIKO XORIO at any time by posting the relevant amendment on the website www.biologikoxorio.gr.
• The membership card is not a credit or debit card. The member may only enjoy benefits, as these are set out and announced at www.biologikoxorio.gr.
• In order to earn or redeem points, the member must be a member of the Rewards Program and identify themselves as a member at the cash register of a physical store and/or at www.biologikoxorio.gr.
• The member is entitled to 1 point for every €1 spent on purchases made at physical stores and at www.biologikoxorio.gr. Such points may be redeemed for value coupons for purchases at BIOLOGIKO XORIO stores and at www.biologikoxorio.gr, in accordance with the applicable Rewards Program and the applicable method for redeeming earned points per transaction.
• If the member returns a product from a transaction that involved the redemption of points, the points deducted upon redemption may not be refunded to the member’s card upon return of the product.
• For every 300 points redeemed, the member receives one electronic coupon worth €3, with a validity period of 2 months from the date on which it is obtained.
• In addition, the member receives further electronic coupons based on the purchase points they have collected from purchases at BIOLOGIKO XORIO stores and at www.biologikoxorio.gr within a calendar month, with a validity period of 2 months from the date on which they are obtained. No points are redeemed for the acquisition of coupons in this category. The reward based on monthly spending is determined as follows:
  
  

1. During the member registration process at BIOLOGIKO XORIO stores, at www.biologikoxorio.gr and through the GREEN GURU APP, the member’s mobile phone number is verified, which must be registered with a Greek mobile phone provider. The member is registered in the scheme and may thereafter collect points. In order to redeem points and use any benefit, full member registration is required (completion of the registration form).
2. Registration with a mobile phone number that already exists in the database cannot be completed.
3. The electronic card, the number of points and the right to use a coupon cannot be replaced or redeemed for cash. Depending on the points collected by the member, the member may only redeem those points and receive the corresponding discount amount. BIOLOGIKO XORIO reserves the right to unilaterally amend the Rewards Program and to modify or replace the amount of purchase rewards by informing members through a relevant posting on www.biologikoxorio.gr.
4. The member declares that all information contained in their application is true and accurate and is responsible for its correctness. BIOLOGIKO XORIO shall not be liable for granting member benefits where the member has provided incorrect or inaccurate personal details.
5. BIOLOGIKO XORIO may, at its sole discretion, terminate the GREEN GURU loyalty program, refuse the electronic issuance of a Rewards Program card and cancel electronic cards of the Rewards Program.
   
   
   2. REVISION — EXPIRY — TERMINATION

• BIOLOGIKO XORIO has the right to terminate this agreement with the member at any time, without notice or justification, or to prohibit any use of the card. In any case, if the member fails to comply with these Terms and Conditions, or in the event of misuse or attempted fraud through the membership card, all points will be deleted and all benefits will be revoked.
• The membership card provides its holder with benefits for as long as the member holding it is recognized as a valid member of the GREEN GURU Rewards Program and for as long as the GREEN GURU Rewards Program remains in force. BIOLOGIKO XORIO reserves every right, at its sole discretion, to change this time period and to unilaterally amend any term of this agreement, including the reward system, the method of calculating points and the amount of purchase rewards, as well as to amend or terminate the GREEN GURU Rewards Program at any time.
• BIOLOGIKO XORIO has the discretion and the right to activate or deactivate the card and/or to discontinue the Rewards Program at any time, without notice or justification, as the GREEN GURU Program constitutes a voluntary benefit provided by the Company.
• Any amendment to GREEN GURU shall be communicated at www.biologikoxorio.gr and shall be considered valid and sufficient notification. The member shall have no claim against BIOLOGIKO XORIO for such changes or for the discontinuation of the GREEN GURU Program, as the member hereby acknowledges that it is a rewards program provided at BIOLOGIKO XORIO’s discretion.
• If, for any reason, BIOLOGIKO XORIO amends part or all of the Program terms or discontinues the Rewards Program, the participant shall have no claim against the Company, as the participant hereby acknowledges that it is a rewards program provided at the Company’s discretion.
• Points earned by the member are valid for 12 months from the date of the respective transaction on the basis of which they were earned or from the date of the promotional activity from which they were earned. Members may be informed at any time of the total active points they have collected from their purchases and/or from promotional activities in the following ways: a) through their account at www.biologikoxorio.gr, b) through BIOLOGIKO XORIO stores, and c) through their profile on the BIOLOGIKO XORIO APP.
• Points and coupons may be redeemed at all BIOLOGIKO XORIO physical stores and soon at www.biologikoxorio.gr.
• BIOLOGIKO XORIO also reserves the right to remove a member from the Program and terminate the validity of their card in the GREEN GURU Rewards Program in any case where the member objects to or restricts the processing of their personal or non-personal data (except for the management of commercial communication and direct advertising to their contact details), or requests the deletion of the personal data they have disclosed or which are generated from their transactions with the GREEN GURU Rewards Program card, because in such cases it is not possible for the Rewards Program and BIOLOGIKO XORIO’s contractual obligations to operate.
• In the event of a member’s request to be removed from the GREEN GURU Rewards Program, BIOLOGIKO XORIO retains the member’s personal data for thirty (30) days from the date of their removal. Even after the expiration of these 30 days, BIOLOGIKO XORIO shall retain the tax data relating to the member’s purchases, while certain basic member data shall also be retained in its records in order to ensure the lawfulness of their processing (e.g. the mobile phone number and email address in encrypted form, the date of registration and removal from the Rewards Program), for the purpose of safeguarding BIOLOGIKO XORIO’s legitimate interests.
• If, following their removal, the member wishes to rejoin the GREEN GURU Rewards Program, they will need to register again in the Program, as the card for which they had requested deletion cannot be reactivated.

3. PERSONAL DATA POLICY

3.1 Legal Basis and Transparency of Processing — Updating Data

BIOLOGIKO XORIO informs the member, and the member of the Program acknowledges that they are aware of the following:

3.1.a. For the processing of the data of members of the GREEN GURU Rewards Program, as described below, BIOLOGIKO XORIO relies on the following legal bases:

Performance of a contract: In order to achieve the purposes of this agreement and of the GREEN GURU card, namely a) the member’s participation in the Program through the logging and analysis of their purchases and the reward of the member with points and benefits from their purchases, b) informing the member about special offers and preferential services, and c) the general analysis of the general purchasing trends of Program members, it is necessary to process the personal data provided by the member upon registration in the GREEN GURU Program and the data generated from their transactions.

Legitimate interests: BIOLOGIKO XORIO reserves the right to process the member’s personal data in order to improve the management of its customer base and promote its products.

Consent of the data subject: The member has consented, by registering in the Program, to the processing by BIOLOGIKO XORIO of the personal data communicated by the member upon registration and of the data arising from their transactional relationship with BIOLOGIKO XORIO, for the purposes referred to in the Program Terms of Use.

BIOLOGIKO XORIO also reserves the right to regularly inform the member by telephone, email, mobile phone message (SMS/Viber) or any other appropriate means of communication it may choose, using the contact details lawfully obtained in the context of their registration in the GREEN GURU loyalty program, about its products and services in the context of their transactional relationship (Article 11 par. 3 of Law 3471/2006) and provided that the member has not objected to such communication. Upon registering in the GREEN GURU Rewards Program, members accept that communications may be sent to them by email, SMS or Viber messages and by post. Such information may include preferential and specialized information about its products, special and/or general offers, promotional activities and contests. BIOLOGIKO XORIO may also communicate with the member through messaging services such as SMS, Viber, etc., for the purposes of better communication with members and controlling communication costs. Members have the option to select the communication channels that BIOLOGIKO XORIO will use to inform them, or to request the termination of commercial communication, through their personal account at www.biologikoxorio.gr and through the GREEN GURU APP. If the member has objected to commercial communication from BIOLOGIKO XORIO, they will not be able to receive informational and promotional messages. It is clarified that BIOLOGIKO XORIO shall continue to use the communication channels for non-commercial communication with the member concerning the use of their card and these Terms and Conditions.

3.1.b. The member has the right of access and rectification, as well as the obligation to update their personal data, and must promptly notify the Company of any changes thereto. Any change, specifically to the mobile phone number declared by the member upon registration in the GREEN GURU Program or subsequently, shall be made only through their personal account at www.biologikoxorio.gr and through the BIOLOGIKO XORIO APP.

3.2 Type and Recipients of Personal Data — Member Rights

3.2.a. Type of Personal Data

BIOLOGIKO XORIO collects and processes personal data entered by the member upon registration (first name and last name, mobile phone number, postal address, email (optional) and date of birth (optional), as well as data generated from the member’s use of the card:

• for the performance of the terms of the GREEN GURU Rewards Program;
• for the communication of general or special offers to the member and to inform them about its products and services;
• for the provision of card benefits and the analysis and study of customer purchasing trends (product categories selected, visit frequency, type of products chosen by customers, response to general and specialized offers, etc.), in order to improve the management of BIOLOGIKO XORIO’s customer base and the provision of products and services that best suit said customer base;
• for the fulfilment of its obligations under the law, such as when the relevant data are requested by tax authorities in the context of audits, or to serve its obligations and legitimate interests, such as in cases before regulatory, administrative or judicial authorities, and to ensure that the member is an adult natural person and a resident of Greece.

3.2.b. Data Recipients

For the data necessary to serve each of the above processing purposes and within the scope of each recipient’s responsibilities, the recipients of the member’s data may be:

1. The company under the name “INTELIQUA A.E.”, which provides CRM services and which has undertaken, among other things, the registration, updating and maintenance of the database containing member data as a data processor on behalf of BIOLOGIKO XORIO and in accordance with its instructions and documented orders, and/or any other company that may in the future provide the same services to BIOLOGIKO XORIO in replacement of or in cooperation with the above company.
2. External partners providing call center and data analysis services, to whom the data necessary for the performance of their duties and the servicing of members are transferred under strict restrictions and procedures.

When registering and processing the member’s personal data, BIOLOGIKO XORIO’s employees and agents, as well as any data processors acting on its behalf, fully comply with the provisions of the European General Data Protection Regulation 2016/679 and with the applicable Greek legislation and case law on personal data protection and are contractually bound to comply with their relevant obligations.

3.2.c. Data Subject Rights

Each member, as a data subject, may at any time exercise their rights as provided for in the General Data Protection Regulation EU 2016/679 (in particular Articles 12 to 23 thereof) and national legislation, and in particular:

1. the right to be informed about and access their personal data processed by BIOLOGIKO XORIO in the context of the GREEN GURU rewards card;
2. the right to restrict the processing of their data relating to the GREEN GURU rewards card;
3. the right to rectify or erase part or all of their personal data relating to the GREEN GURU rewards card (right to be forgotten);
4. the right to object, i.e. to object to the processing of their personal data relating to the GREEN GURU rewards card;
5. the right to data portability of their data relating to the GREEN GURU rewards card.

The member may exercise the above rights in particular as follows:

For the right/obligation of access and rectification/completion of personal data, BIOLOGIKO XORIO enables members of the GREEN GURU Program to view, rectify/complete their personal data:

• by logging in to their profile on the website www.biologikoxorio.gr;
• through the profile section on the BIOLOGIKO XORIO APP.

For the right to receive a copy or to data portability of personal data, BIOLOGIKO XORIO enables members of the GREEN GURU Program to receive their personal data and/or transmit them to another data controller in the format to be indicated by the competent supervisory authority, by written letter to BIOLOGIKO XORIO at the address 128 Alexandras Avenue, Athens, Attica, Postal Code 11471 — Attn: DPO.

For the right to restriction of processing, the right to erasure of part or all of the data (right to be forgotten), as well as the right to object, i.e. to raise objections to the processing of their personal data relating to the GREEN GURU rewards card, the member may submit a relevant request by written letter to BIOLOGIKO XORIO at the address 128 Alexandras Avenue, Athens, Attica, Postal Code 11471 — Attn: DPO.

In the event that the member exercises any of the above rights, BIOLOGIKO XORIO shall take all possible measures to satisfy the request within one (1) month from the date of its valid submission and, if more time is required, shall duly inform the member. In such case, the member is informed that it is possible that certain minimum necessary personal data may be retained for the protection of BIOLOGIKO XORIO’s legitimate interests. It is clarified that, in order for the exercise of the above rights to be considered valid, the member may be required to identify themselves, in order to ensure that the personal data for which any of the above actions are requested actually belong to the member/natural person requesting the specific action.

The member may be removed from the GREEN GURU Program by submitting a relevant request through:

1. the contact form at www.biologikoxorio.gr/en/contact;
2. by telephone to the Customer Service Department at 213 0095 580. Operating hours: Monday — Friday, 09:00 — 17:00.

Each member may also at any time request the cessation of commercial communications through one or more of their communication channels (email, SMS to their mobile phone or Viber to their mobile phone, post) through their personal account at www.biologikoxorio.gr and through the BIOLOGIKO XORIO APP.

Members should also be aware that, due to the nature of the operation of the GREEN GURU Rewards Program, the exercise of any of the above rights, and in particular the right to object to or restrict processing and the partial or complete erasure of the member’s data, may cause difficulties in the smooth operation of the Rewards Program; therefore, BIOLOGIKO XORIO reserves the right to delete the points collected by the member within thirty (30) days from the submission of the relevant request and to temporarily deactivate the member’s rewards card.

3.2.d. Personal Data Retention Period

The member’s personal data shall be retained and processed by BIOLOGIKO XORIO until the member cancels the GREEN GURU card. Nevertheless, certain necessary personal data relating to the member’s transactional relationship with BIOLOGIKO XORIO, as well as the member’s declarations regarding the processing of their data, may remain as information concerning the member in BIOLOGIKO XORIO’s systems in order to ensure proof of the lawfulness of the processing of their data by BIOLOGIKO XORIO and to safeguard the lawful claims of the parties.

3.2.e. Special Categories of Data

The member is informed that BIOLOGIKO XORIO does not collect nor require the disclosure by the member of their sensitive personal data (special categories of data) for the purposes of the GREEN GURU membership card.

3.2.f. Transparency Obligation

For any information regarding their personal data as well as its processing and protection, the member may contact the Data Protection Officer (DPO) of BIOLOGIKO XORIO at [email protected] and, if they consider that they are not satisfied with BIOLOGIKO XORIO’s actions, they are informed that they have the right to lodge a complaint with the competent supervisory authority (Hellenic Data Protection Authority, 1-3 Kifissias Avenue, Postal Code 115 23, Athens).

3.2.g. Technical and Organizational Protection Measures

BIOLOGIKO XORIO, the data processors acting on its behalf and its agents/assistants implement appropriate technical and organizational measures for the best possible protection of personal data against accidental or unlawful destruction or loss, alteration, unlawful disclosure of or access to them, and generally against unlawful processing (including remote access), as well as to ensure the ability to restore their availability and access to them.

These measures aim to ensure a level of security appropriate to the risk to which the specific data may be exposed, always taking into account the type and sensitivity of the data, the technical capabilities of BIOLOGIKO XORIO and its partners, technological developments, implementation cost and the nature, scope, context and purposes of each specific processing operation, while also implementing procedures for regularly testing, assessing and evaluating the effectiveness of these technical and organizational measures.

In any case, BIOLOGIKO XORIO, the data processors acting on its behalf and its agents/assistants are contractually bound to maintain the confidentiality of members’ personal data and not to disclose or allow access to them to any third party without prior notification of the member, except in cases expressly provided for by law.

4. TERMS FOR REDEEMING POINTS OF THE GREEN GURU PROGRAM

• The member is entitled to redeem their points, provided that they are an active member and have completed their registration (completion of the registration form), and provided that the current balance of credited and available points on their electronic card is at least equal to the number of points corresponding to discount coupons worth €3. For this purpose, the member will be able to calculate the total number of points that have been credited to them and are available. The member is not entitled to substitute part or all of the points they have collected for money, nor to redeem those points for cash. Coupons have an expiry date of 2 months from their issuance.
• If the member returns all or part of the products they purchased and from which they earned points, the points corresponding to the amount of the return will be deducted from their account, provided that they receive a refund. If the member returns a product from a transaction that involved the redemption of points, the points deducted upon redemption may not be refunded to their card.
• Each time the member redeems points corresponding to a discount coupon, an equal number of points is deducted from their available points balance.
• Purchases made using a discount from points redemption are not eligible for a cash refund.
• The discount cannot be exchanged for cash.
• In order for the member to be entitled to the relevant discount, they must make purchases of equal or greater value.
• BIOLOGIKO XORIO reserves the right to change at any time the points calculation system, as well as the number of points that the member is required to collect.

5. OTHER TERMS

BIOLOGIKO XORIO shall not be liable for any damage, initial or consequential, positive or negative, direct or indirect, suffered by the member from the use and implementation of the GREEN GURU Rewards Program. In any case, any liability of BIOLOGIKO XORIO shall be limited exclusively and solely to the re-crediting of any lost points to the member’s Rewards Card. BIOLOGIKO XORIO shall not be liable for any damage to the member, other members of the Program or third parties due to false or inaccurate statements made by the member, in particular regarding the member’s personal information.

These Terms constitute the sole and complete contractual text governing the relationship between BIOLOGIKO XORIO and the members of the GREEN GURU Rewards Program and supersede any previous version thereof. They shall remain in force as they stand until any subsequent amendment by BIOLOGIKO XORIO, which shall take effect either upon notification to members or upon posting on www.biologikoxorio.gr.

These Terms apply to members of the GREEN GURU Program in Greece and govern their relationship with BIOLOGIKO XORIO from 29/6/2026. They shall be interpreted in accordance with Greek law, and any interpretation or dispute between the member and BIOLOGIKO XORIO shall fall under the exclusive jurisdiction of the Courts of Athens.
